When applying to register an Australian business picking a business name you should consider the following.

1.The business name must not be the same as the current name. First of all, the business name cannot be the same as the current name. And there are some limitations that must be referred to, there are some words that can't be used without the permission of the head of the government department. For example: financial institutions, private equity, royalty, etc..

You cannot apply words or phrases that are likely to defraud us of our views on the activities of the business. This relates to liaison with the Australian Government, the Crown or any veterans' organizations. If a name is thought to be offensive or suggests illegal activity, it may be rejected.

  2.Reserve a usable name.

If you are not prepared to apply to register your business in advance, but want to ensure that you have a usable name, you can apply to reserve it. If ASIC grants your application, they will reserve the meaning of the name for 2 months. If you want to increase this period, you must apply again to reserve the name.

  3.Check current trademarks or names.

Even if you have reserved or applied to register a name, a business with a similar trademark or name may take action against you. It is your responsibility to be aware of any similar names or trademarks that are likely to jeopardize your name.

4.The name of the business must indicate its national legal influence.

The responsibilities and status of its members must be primarily expressed in its name. If the liability of the members of the business is limited to their unpaid equity, then the name of the business must end with the words “Right to Use Limited Liability Company”. If the liability of the members is unlimited, the name of the enterprise must end with “dedicated”.
